What we do

You book an event. We give you a link and a code. Your guests use it to send us photographs and videos from their phones. You can view your private album and download the saved original files. Your US$49 booking covers collection and downloads. Live Wall and Premium/AI recaps are planned options, unavailable to buy and not included in this booking.

What you are responsible for

Sharing the code with your guests, and telling them that what they add goes to you. You confirm you have the right to collect and keep the material your guests send.

What we are responsible for

Collecting uploads, making the saved original files available to you, and operating the stated deletion schedule. See the refund policy.

How long we keep things

Every album is hosted for a year. It is deleted thirty days after the first anniversary of your event, or of the day you created it when no date was given; that date is shown in your album. A year on, we email you a reminder to save the rest. Guests receive optional thank-you and anniversary updates only when they choose them; they can unsubscribe in either email. After the date, the next daily cleanup removes hosted originals, working copies, thumbnails and recaps. Downloaded copies are yours to keep. Accepting the prepared download records delivery; it does not shorten the year, and nothing you fail to do shortens it either.

The material itself

Your guests keep the rights to what they shot. Collecting a file does not transfer its copyright to you. Obtain permission for uses beyond the event collection they agreed to. We do not use uploads in advertising, sell them or train AI on them.

Permission for new uploads

For uploads accepted under version 3, you grant their.photos and its service providers a non-exclusive, royalty-free licence to store, copy, process (including previews and format conversion), display and deliver your files solely to operate this event album until removal or expiry. You permit the host to view and download them. If the host enables guest viewing, anyone holding the guest link can view them; if saving is enabled, they can download and share copies for personal use. These permissions do not transfer copyright or grant advertising, resale or AI-training rights.

You confirm you own the necessary rights or have permission from their owner, and have any permissions required by applicable law from people shown, including a parent or guardian where needed for a child. Do not upload intimate, sensitive or private material without the necessary permission. Hosts and guests must obtain separate permission for uses beyond this limited grant.

We record the permission version and acceptance time on each new upload. This wording does not expand earlier grants: earlier files without guest-sharing permission remain available to the host, but are not displayed or downloadable through the guest gallery. Removing an upload ends its availability on the service; copies someone has already saved or shared cannot be recalled. Contact hello@their.photos if you cannot remove a file from the device used to upload it or need to report a privacy concern.

Uploads

Guests choose what they send. We cannot guarantee participation, particular moments, or the quality of their recordings. Files can be up to 5 GB each, with up to 500 uploads per guest device. Keep the upload page open until transfers finish. Network and device interruptions can require a retry. Our liability is limited to what you paid us.

Acceptable use

Send only what you shot or have the right to share, from an event you were part of. Do not send anything unlawful, anything sexual involving a minor, anything meant to harass or expose the people in it, or anything designed to damage a device. The host can remove any upload, and anyone holding the album link can report one from the album page. We remove reported material that breaks these rules, we can close an album being used for it without a refund, and we report material involving the abuse of children to the authorities, as the law requires.

Under 17 U.S.C. § 512(c)(3), a notice must include: (1) a physical or electronic signature of the copyright owner, or of someone authorised to act for them; (2) identification of the copyrighted work you believe is infringed; (3) identification of the material you believe is infringing and where it is, such as the album link; (4) your name, address, telephone number and email address; (5) a statement that you believe in good faith that the use is not authorised by the copyright owner, its agent or the law; and (6) a statement that the information in the notice is accurate and, under penalty of perjury, that you are authorised to act for the copyright owner.

We remove or disable access to material that is the subject of a valid notice. In appropriate circumstances, we close the albums and accounts of subscribers and account holders who are repeat infringers.

Earlier bookings

Any additional features or guarantees expressly included in an earlier booking continue to apply to that booking.

Ending it

You can cancel any time before your event for a full refund. We can decline or end a booking if the material sent to us is unlawful, or if the service is used for something other than an event you are hosting.
